Welcome to Fitora AI. These Terms and Conditions ("Terms") govern your access to and use of the Fitora AI website at www.fitoraai.com, our AI-powered virtual try-on platform, API services, and all related tools and documentation (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, please do not use our platform.

1. Eligibility & Account Registration

• You must be at least 18 years old and have the legal authority to enter into agreements on behalf of your business to use our Service.
• You are responsible for maintaining the confidentiality of your account credentials, including API keys.
• You agree to provide accurate, current, and complete information during registration and to update it as necessary.
• You are responsible for all activity that occurs under your account.

2. Service Description

Fitora AI provides:

• Virtual Try-On API: An AI-powered engine that generates realistic images of users wearing selected garments.
• Frontend Components: Pre-built UI components for integration into your e-commerce platform.
• Dashboard: A management interface for monitoring usage, managing settings, and accessing billing information.
• Documentation: Technical guides and API references for integration.

3. Subscription & Payments

• Fitora AI operates on a subscription-based model. Plans, pricing, and feature tiers are described on our website and may change with notice.
• By subscribing, you authorize Fitora AI to charge the applicable fees to your chosen payment method on a recurring basis (monthly or annually).
• All fees are quoted in the currency specified at checkout. Applicable taxes will be added as required by law.
• We use trusted third-party payment processors (including PayHere) to handle your payment information securely. Fitora AI does not store full payment card details.
• Failure to pay may result in suspension or termination of your access to the Service.

4. API Usage & Rate Limits

• Your API access is subject to the usage limits specified in your subscription plan.
• You must not exceed the rate limits or attempt to circumvent usage restrictions.
• API keys are confidential and must not be shared publicly or embedded in client-side code without proper security measures.
• We reserve the right to throttle or suspend API access if we detect abuse, excessive usage, or security threats.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights.
• Upload or transmit malicious code, viruses, or harmful content.
• Process images that contain inappropriate, explicit, or illegal content.
• Reverse-engineer, decompile, or attempt to extract the source code of our AI models or algorithms.
• Resell or redistribute our API access without written authorization.

6. Intellectual Property

• All content, branding, AI models, software, documentation, and materials on the Fitora AI platform are the intellectual property of Fitora AI or its licensors and are protected by applicable intellectual property laws.
• You retain ownership of any content (images, garment data) you upload to the platform.
• You may not copy, modify, distribute, or create derivative works from our platform without prior written consent.

7. Service Availability & SLA

• We strive to maintain high availability of our Service but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance.
• Fitora AI will use commercially reasonable efforts to maintain an uptime of 99.5% for API services, measured on a monthly basis.
• We are not liable for downtime caused by factors beyond our reasonable control, including but not limited to natural disasters, internet outages, or third-party service failures.

8. Returns & Refunds

9. Limitation of Liability

• To the maximum extent permitted by law, Fitora AI, its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Our total liability for any claim arising from these Terms shall not exceed the amount you paid to Fitora AI in the twelve (12) months preceding the claim.
• We provide the Service "as is" and make no warranties, express or implied, regarding the accuracy, reliability, or suitability of the AI-generated results.

10. Indemnification

You agree to indemnify and hold harmless Fitora AI and its team from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Termination

• You may terminate your account at any time by cancelling your subscription through the dashboard.
• We reserve the right to suspend or terminate your access at any time for violation of these Terms, non-payment, or any conduct we deem harmful to the Service or other users.
• Upon termination, your right to use the Service ceases immediately. Data retention after termination is governed by our Privacy Policy.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sri Lanka. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after any changes constitutes your acceptance of the revised Terms. For material changes, we will provide notice via email or through the platform dashboard.
